Milltown Airfield Solar Farm

Variation Application

 

Under the Electricity Generating Stations (Applications for Variation of Consent) (Scotland) Regulations 2013, Milltown Solar PV Ltd (the applicant) is making an application under section 36C of the Electricity Act 1989, seeking a direction that the deemed planning permission be varied to extend the duration of the consent (from 30 years to 40 years) for the Milltown Airfield Solar PV electricity generating station at Milltown Airfield, between Lhanbryde and Lossiemouth, Moray. The original deemed Planning Permission for this generating station was granted by Scottish Ministers on 25 May 2018 under Energy Consent Unit reference ECU00000452.

As required by Regulation 4, ‘Publication and service of notice of application of the Electricity Generating Stations (Applications for Variation of Consent) (Scotland) Regulations 2013, the applicant is required to adhere to the following:

 

4.(1) Notification of the variation application must be given in accordance with this regulation.
(2) The applicant must—
(a) publish on a website (“the application website”)—
(i) a summary of the variation application;
(ii) a copy of the application;
(iii) a link to the relevant section 36 consent, any section 57 direction given on granting it and any statement (in the form of a decision letter or otherwise) given by the appropriate authority under regulation 10(3) of the EIA Regulations when granting the relevant section 36 consent; and
(iv) any environmental statement prepared in relation to the proposed development;

 

 

The Regulation above is addressed by the following:

  • i     This website shall be considered as the application website
  • ii         The variation application seeks a direction from Scottish Ministers that the deemed planning permission be varied to extend the duration of the consent (from 30 years to 40 years) for the Milltown Airfield Solar PV electricity generating station. For the avoidance of doubt, no further variations are sought under this application.

  • v        This project has been screened for EIA by the Moray Council. A copy of its screening opinion is available to view as part of the application documents. The Screening opinion is referenced as appendix 7
